A Drunk person is not capable of giving consent to a Man for Sex according to a Senior Lawyer, Barrister Pelumi Olajengbesi.
He made the submission on social media, Facebook while buttressing Deji Adeyanju advice, urging people not to have sex with a drunk persons to prevent been accused of
rape the next morning when they regained their conscious.
Deji Posted; ‘Don’t ever have sex with a drunk person no matter how much pressure they put on you to do so. When they become sober in the morning; they might turn it to rape. This is a free but very expensive advice.”
According to Pelumi, He stated that,”Let me put it better self, A Drunk person is not capable of giving consent to a Man for Sex no matter how much she leads you on, she is capable of withdrawing her consent.
Other contributors at Arinuyo Ibiseun asked: Who is a drunk person then? How can drunkenness be proven? Anybody who is after you can easily claim to have been drunk after a bottle of Smirnoff ice.

Amaka Chude A drunken person is treated as a person of unsound mind until s/he becomes lucid. So having sex with a drunken person may amount to rape if the partner proves her state of drunkenness. Her consent is automatically vitiated by the reason of her state of mind at the time sex took place.
